FOR RELEASE ON APRIL 1, 1994 PETITION FOR WRIT OF MANDATE (Cellio v. SCA) FILED IN SANTA CLARA SUPERIOR COURT A legal action, Petition for a Writ of Mandate, was filed against the Society for Creative Anachronism, Inc., on March 24, 1994 and amended on March 25, 1994. The Petition was filed in Santa Clara County, California -- the County in which the SCA maintains its corporate office. A hearing has been scheduled for Thursday, May 5, 1994. The Petitioners are seeking to have the court command the SCA to allow the petitioners and their attorneys to inspect and copy all books of account, minutes of Board meetings, membership lists, and any other records which the petitioners wish to see. SCA Legal Counsel has reviewed the Petition and has advised the Board that it is without merit and that the Court is expected to deny the petition. A formal response by the SCA to the Petition will be filed with the Court and oral arguments presented at the hearing. All members of the Board of Directors and Anthony Provine (Executive Director), Renee Signorotti (Registrar), and Victoria Tisdale (former Director) have been individually named as respondents in the case, but there is no request for a money damages award against any individual. The Society will incur legal expenses in order to defend itself in this proceeding. The only valid issue in this matter is whether California law requires the SCA to provide the records in question. The rights of members under SCA Bylaws (Article X) is not in question here. The SCA has complied with the Bylaws and responsibly discharged its obligations under them. The Board considers the filing of a lawsuit by the Petitioners to be unfortunate and regrettable. The Petitioners had been receiving information and cooperation from the Board and corporate office at the time the Petitioners were taking steps to file the Petition. The Board regrets that it is required to spend any amount of the SocietyÕs scarce resources to defend against this suit. -------------------------------------------------------------------- Again, the preceeding was not mine.
